Pendekatan Maqashid dalam Ushul Fiqh Sebagai Basis Pengembangan Hukum Islam Progresif

The development of modern society has generated various new issues that require adaptive and contextual responses from Islamic law. In addressing these dynamics, the maqashid al-shari’ah approach within the study of ushul fiqh has become one of the important methods for developing progressive Islamic legal thought. This approach emphasizes that the primary objective of Islamic law is to realize human welfare and to prevent harm in social life. This study aims to analyze the role of the maqashid approach in ushul fiqh as a foundation for the development of progressive Islamic law that is capable of responding to contemporary challenges. This research employs a qualitative method with a library research approach. The data were obtained from various literature sources such as classical books of ushul fiqh, scientific journals, and contemporary studies related to maqashid al-shari’ah. The results of the study show that the maqashid approach provides a more flexible methodological framework in the process of ijtihad, enabling Islamic law to develop dynamically without abandoning the fundamental principles of the Sharia. Thus, the maqashid approach in ushul fiqh has a strategic role in developing Islamic law that is more responsive, humanistic, and relevant to the needs of modern society.
Abstrak
Perkembangan masyarakat modern menimbulkan berbagai persoalan baru yang membutuhkan respons hukum Islam yang adaptif dan kontekstual. Dalam menghadapi dinamika tersebut, pendekatan maqashid al-syari’ah dalam kajian ushul fiqh menjadi salah satu metode penting dalam mengembangkan pemikiran hukum Islam yang progresif. Pendekatan ini menekankan bahwa tujuan utama syariat Islam adalah mewujudkan kemaslahatan manusia serta mencegah terjadinya kerusakan dalam kehidupan sosial. Penelitian ini bertujuan untuk menganalisis peran pendekatan maqashid dalam ushul fiqh sebagai basis pengembangan hukum Islam progresif yang mampu menjawab tantangan zaman. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan. Data diperoleh dari berbagai sumber literatur seperti buku klasik ushul fiqh, jurnal ilmiah, serta kajian kontemporer yang berkaitan dengan maqashid al-syari’ah. Hasil penelitian menunjukkan bahwa pendekatan maqashid mampu memberikan kerangka metodologis yang lebih fleksibel dalam proses ijtihad sehingga hukum Islam dapat berkembang secara dinamis tanpa meninggalkan prinsip-prinsip dasar syariat. Dengan demikian, pendekatan maqashid dalam ushul fiqh memiliki peran strategis dalam mengembangkan hukum Islam yang lebih responsif, humanis, dan relevan dengan kebutuhan masyarakat modern.
